What is the first step?
Fill out an application online or over the phone. We'll take care of getting the rest of the information from your attorney.
How long does it take to get the money?
We'll request the necessary case documents from your attorney right away. Once we get the information from them, you can be approved within two days.
Is this advance the same as a lawsuit loan?
No, a loan has to be repaid no matter what happens. This advance is based entirely on your lawsuit. If you don't win your case, you don't owe us anything.
Are there any upfront fees?
Applying is free. If you are approved, there may be a processing and/or origination fee included in the advance. These fees, like the advance, do not have to be paid until your case settles.
How much do I have to pay back?
If the case is unsuccessful, you owe us nothing. If the case does settle, you pay back our upfront costs plus a monthly usage fee. When you are approved, before you sign anything, you will see a chart showing exactly how much you would owe.
What are the fees?
Fees are determined on a case-by-case basis, depending on the type of lawsuit and the strength of the case. Because each lawsuit is unique, we are unable to determine the fees until your case has been approved. At that time, we can explain the fees to you and show you exactly what you would owe, before you sign anything.
When do I have to pay the money back?
You don't owe us anything until your case settles. When your attorney receives the money from your settlement, judgment or verdict, he or she will pay any liens, including ours, before distributing the money to you. You can also choose to pay off the advance at any time.
Why was I approved for less than what I requested?
The amount of money that you are approved for is the most our investors are willing to advance at this time. As the case progresses and more information is available, you can call us to request an additional advance, and we can re-evaluate your case at that time.
If my child (a minor) was injured in an accident, can I get an advance?
No. The person applying for the advance must be of legal age. A minor cannot be bound to a legal contract, nor can a parent or legal guardian on their behalf. (Even if the parent is named on the lawsuit, we can't fund if the injured person is a child.)
Do I need to have an attorney?
Yes, you must have an attorney for CaseFunding to consider your case.
What if I need the money to hire an attorney?
We can only provide an advance if a lawyer already represents you and is familiar with your case.
Does CaseFunding work with pharmaceutical lawsuits?
