What is the first step?

We take your contact information (incl. phone numbers, address, e-mail etc.) and your attorney's contact information. We contact your attorney and request case information so that we can evaluate the case and determine how much money we can offer you against your case.

Do I have to have an attorney?

Yes. We can only fund you if you are represented by an attorney. Your attorney is required to sign a portion of the agreement, and we cannot give you a cash advance without this part of the agreement signed.

How long does it take to get the money?

Typically, we can approve your case within 24 hours after we have received the information necessary to evaluate your case. Once the case has been approved, a funding agreement is sent to you and your attorney to be signed. Upon receipt of a properly executed agreement, the money can be wired into your account the same day or a check can be sent to you overnight.

Is this advance the same as a conventional loan?

No, but it's an easy way for you to get money when you need it. Conventional loans must be repaid no matter what. Our advance must be repaid only upon the successful resolution of your case. Your attorney will pay us our portion directly from the proceeds of the case.

Are there any upfront fees?

No, applying is free. However there may be a processing or origination fee included in the approved advance. Remember, you pay nothing until after the case settles.

How much do I have to pay back?

If your case does not settle successfully, you pay us back nothing. If it does, you pay us back our upfront costs plus a "usage" fee. A schedule will be attached to your contract which lists the amount of money you will pay us back if your case is successful. This amount is determined on a case by case basis.

What are the fees (usage)?

All of our fees are determined based on the merits of the case. Once your case has been reviewed and approved we will be more than happy to go over the fees with you and your attorney. Our usage fees are higher than interest rates charged by credit card companies due to the risks we take.

When do I have to pay the money back?

When your case settles your attorney will pay any liens, including ours, before he disburses the money to you. You can also choose to pay off the advance at any time based on the payment schedule attached to your funding agreement.

Why was I approved for less than what I requested?

After reviewing your case information we determined that we could only advance this amount at this time. As the case progresses, you can call us for additional advances and we can re-evaluate your case at that time.

Why was my case denied?

After evaluating your case we've determined that it does not meet our funding criteria. It does not mean you do not have a good case-simply that we are unable to advance you money at this time.

If my child (a minor) was injured in an accident, can I get an advance?

No. The person applying for the advance must be of legal age. A minor cannot be bound to a legal contract nor can the parent or legal guardian take an advance against the child's pending lawsuit or settlement.

Do you fund Workers' Comp cases? Why not?

No. We fund a variety of types of cases but cannot fund Workers' Compensation because of different laws in different states.

If my spouse is part of the lawsuit does he/she have to sign?

Yes. Remember you are requesting an advance against future proceeds that will be awarded to the both of you.

Who evaluates the cases? Can I speak to them?

The underwriters. They are a team of attorneys who will evaluate your case and determine if it meets the criteria for a successful funding. After a decision is made on your case all of the evaluation information is forwarded to the supporting staff. They will be able to explain the result of the evaluation. If you believe there is additional information that may influence the underwriter's decision to fund your case, you should let us know. We will be happy to discuss this with your attorney.

Can I get more money? When?

Yes. We are contacted over and over again by our clients looking for additional cash advances on the same case. In order to get additional money, you call us and let us know how much you are requesting. If anything has changed since you originally applied, let us know. We will contact your attorney to obtain an update on your case and then we will contact you regarding your request.

In what states do you provide cash advances?

Currently the only state we cannot advance money against pending lawsuits is Ohio.

Yes, we advance money against all of these types of claims. We need to obtain certain information from you and your attorney and then we can evaluate your case to determine what type of cash advance we can offer you.
