According to recent reports, four transvaginal mesh cases, each pending in the Southern District of West Virginia, were selected as the first bellwether trials against manufacturer, American Medical Systems. The first of these trials is set to begin on December 3, 2013, with the second trial starting May 6, 2014. Earlier this month, a mistrial was declared in the bellwether trial against C.R. Bard.
Multi-district Litigation in West Virginia
There are currently thousands of transvaginal mesh cases filed in the West Virginia Court, all consolidated into 5 MDLs (Multi-District Litigation). Each of these separate MDLs was created for a specific manufacturer, including American Medical Systems (MDL No. 2325). Others include Boston Scientific Corp. (MDL No. 2326); C.R. Bard, Inc. (MDL No. 2187); Ethicon, Inc., (MDL No. 2327); and Coloplast Corp. (MDL No. 2387).
Plaintiffs and their attorneys are optimistic that given the severity of injuries, these bellwether trials will result in favorable verdicts, which could ultimately lead to a global settlement.
